Terms of Service

1. Eligibility

• You must be at least 18 years of age to create an account and use Cultiwate.
• The Platform is designed for working professionals. While we recommend a minimum of 5 years of professional experience for optimal diagnostic accuracy, this is not a strict requirement for account creation.
• You must provide accurate and complete information during onboarding. Inaccurate information may result in unreliable diagnostic outputs.

2. Acceptable Use

When using Cultiwate, you agree not to:

• Provide false, misleading, or fraudulent information in your profile or assessment responses.
• Share your account credentials or allow others to access your account.
• Attempt to reverse-engineer, decompile, or extract the diagnostic methodology, scoring algorithms, or recommendation engine.
• Use the Platform to harass, abuse, or harm other users, including coaches.
• Use automated scripts, bots, or scrapers to access the Platform or extract data.
• Reproduce, redistribute, or commercially exploit any part of the Platform’s content, reports, or methodology without prior written consent.
• Violate any applicable law or regulation while using the Platform.

Violation of these terms may result in immediate account suspension or termination.

3. Intellectual Property

• Your data — you retain full ownership of your personal data, assessment responses, reflections, and any content you create on the Platform. By using Cultiwate, you grant us a limited, non-exclusive licence to process this data solely for the purpose of delivering our services as described in our Privacy Policy.
• Platform and methodology — the Cultiwate platform, including its diagnostic methodology, career constraint framework, scoring algorithms, recommendation engine, user interface, and all associated intellectual property, is owned exclusively by Cultiwate. All rights reserved.
• Generated reports — career reports generated for you are provided for your personal use. You may share your own report, but you may not commercially redistribute the report format, structure, or methodology.

4. Limitation of Liability

• The Platform provides career analysis, constraint identification, and strategic recommendations based on self-reported data. We do not guarantee specific career outcomes, salary changes, promotions, or employment results.
• Diagnostic outputs and recommendations are informational in nature. You are solely responsible for the career decisions you make based on our analysis.
• The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• To the maximum extent permitted by law, Cultiwate’s total liability for any claim arising from your use of the Platform shall not exceed the amount you paid to Cultiwate in the 12 months preceding the claim.
• Coaches on the Platform are independent professionals. Cultiwate facilitates matching and booking but is not a party to the coaching relationship and is not liable for the advice or actions of any coach.

5. Subscription and Payments

• Cultiwate offers free and paid subscription tiers. Features available on each tier are described on the Platform and may change over time.
• Paid subscriptions are billed monthly through Razorpay. You may cancel at any time from your Settings page; access to paid features continues until the end of the current billing period.
• Refunds are handled on a case-by-case basis. Contact us at contact@cultiwate.com for refund requests.

6. Dispute Resolution

• These Terms are governed by and construed in accordance with the laws of India.
• Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
• Before initiating formal proceedings, we encourage you to contact us at contact@cultiwate.com to attempt to resolve the matter informally.

7. Account Termination

• You may delete your account at any time from your Settings page. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
• We may suspend or terminate your account if you violate these Terms, engage in abusive behaviour, or if your account has been inactive for more than 12 months.
• We will make reasonable efforts to notify you before termination, except in cases of severe violation where immediate action is necessary.

8. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated to you via email or an in-platform notification at least 15 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may delete your account before the effective date. The “Last updated” date at the top of this page indicates when these Terms were last revised.
